PROYECTO DE LEY
Artículo 1º.- Tendrán derecho a la percepción de los beneficios establecidos en la presente ley: Las personas que hubieran estado detenidas, procesadas, condenadas y/o a disposición de la justicia o de los Consejos de Guerra, conforme lo establecido por el Plan CONINTES (Conmoción Interna del Estado). Los beneficiarios deberán residir en la actualidad o haber residido en el momento de la detención en la Ciudad Autónoma de Buenos Aires y no deberán percibir ningún beneficio nacional o provincial por idénticos motivos.
Artículo 2°.- Los beneficiarios tendrán derecho a percibir un subsidio mensual equivalente a una remuneración mensual que no será inferior al monto que percibe un agente categoría A1, del tramo y nivel profesional de la administración de la Ciudad.
Artículo 3°.- El subsidio tendrá el carácter de bien propio, será inembargable, no podrá ser cedido, ni transmitido por ningún acto jurídico.
Artículo 4°.- Los Beneficios establecidos en la presente ley no son incompatibles con sueldos, honorarios, jubilación o pensión que pudiere recibir el beneficiario por otras causas.
Artículo 5º.- El subsidio caduca automáticamente por fallecimiento del beneficiario o por cobro de otro subsidio, reparación o beneficio similar que sea creado a nivel provincial o nacional.
Artículo 6º.- Autorizase al Poder Ejecutivo a realizar las adecuaciones presupuestarias necesarias para garantizar el cumplimiento de la presente ley desde el momento de su entrada en vigencia.
Articulo 7°.- El Poder Ejecutivo reglamentara la presente ley dentro de los 30 días de promulgada.
Artículo 8.- Comuníquese.
Cláusula Transitoria Primera: Los beneficios establecidos en la presente ley quedan sin efecto si entra en vigencia una ley similar, dictada por el Congreso de la Nación, que contemple a los mismos beneficiarios.
